Head On Collision Car Accident in Johns Creek Georgia Nets Another Fatality

Last Saturday, as was mentioned earlier in the week, several people were killed and injured in a head on collision car wreck in Johns Creek, Georgia when a driver, Raymond Myrand, drove the wrong way on State Bridge Road and slammed into the vehicle driven by Kelly Robertson. In Kelly Robertson's vehicle, was her twelve year old, both of whom were life-flighted to area hospitals. The 12 year old is still hospitalized because of the serious nature of his injuries attributable to the auto accident, although he is expected to make a full recovery. What kind of permanent injuries he has sustained because of the car wreck is yet to be determined.

It is now being reported that Kelly Robertson, only 41 years of age, has died because of her injuries in the head on collision car accident. Sadly, this is yet another deadly car accident that has occurred in the past few weeks in the Metro Atlanta area that has involved a wrong-way motorist. A couple days before Thanksgiving, Robert Ayiteyfio was driving intoxicated the wrong way on I-20 East in Atlanta before crashing into Shameyka Welch, resulting in the death of the 24 year old and mother of four. Injured in the deadly car accident were two of Welch's children and her boyfriend. Mr. Ayiteyfio fled the accident scene, but was later caught charged with DUI and vehicular homicide.

Last Tuesday, On December 8th, Jahan Zackery lost his life in another deadly head on collision car wreck when Theus Monroe, traveled the wrong way on a downtown Atlanta connector while drunk.

Dealing With a Car Wreck in Atlanta, Georgia

Car wrecks are surprising, unpleasant events and whether you live in Atlanta, outside of Atlanta or anywhere else in Georgia, the Southeast or the United States, the experience of being a victim in a car crash is similar. If you have been in a car wreck in Atlanta, you are most likely having to deal with the damage to your car and possible personal injuries.

I am going to skip the checklist of things to do immediately after an Atlanta, Georgia car wreck as they have been addressed in a previous blog entry and talk about what to do in the following days, weeks and months. If you are hurt or feel that you are hurt, get checked out by a Doctor or go to the hospital. If you are hurt or claim you are hurt from the car crash and you do not have medical records to back it up, it will make it more difficult to pursue an injury claim related to the car accident with the at fault party's or your own insurance company in the case of a hit & run or if the other driver is uninsured or underinsured.

If you are given a referral to a doctor who is a specialist like and orthopedist or a neurologist, schedule an appointment, see the doctor and do not miss follow up appointments. Gaps in treatment are very damaging to your injury claim and remember, the claimant has the burden of proving to the insurance company and if a lawsuit is filed that reaches trial, to a jury, that they were hurt in the car wreck and are deserving of money damages. If the decision makers are not convinced that you are hurt, your chances of recovering any money will be diminished.

Stay tuned for additional thoughts about this and related car accident matters.

If you or a loved one has been injured or killed in a car wreck in Atlanta, Georgia or anywhere in the United States, I would invite you to please visit either one of my two websites, www.samlevine.com or www.atlantainjurylawyer.net or contact my office, Sam Levine, Attorney at Law.

The deadly car wreck resulted in one wrongful death to a teenager and injuries to three other youths and happened eastbound on River Road near Waldrop when the teen lost control of his car and struck a utility pole. Lawsuits Over Pharmacy Mistakes Settled Behind Closed Doors

A Missouri woman sued her pharmacy, Walgreens, after getting what she thought was a prenatal vitamin that would benefit her unborn child. What Chandra Givens actually got was quite different. She received a chemotherapy drug that adversely affected cell growth. As a result, she filed a federal lawsuit following protracted pain and suffering, which included nausea, vomiting and a host of other neurological symptoms. Worse of all, she miscarried in early April and blames Walgreen's Pharmacy.

In the lawsuit, the Plaintiff claims that Walgreens gave her the incorrect drug. She is seeking unspecified damages and argues that Walgreen's neglected to supervise its employees in, among other things, verifying the accurate filling of the prescription.

What later happened in this case and what appears to be a trend around the country is that these lawsuits are settled out of court. The plaintiff cannot talk about the settlement because of a confidentiality clause in the settlement agreement.

If you or a loved one has been affected by pharmacy error, I would invite you to visit my website, www.samlevine.com or contact my office, Sam Levine, Attorney at Law.

Dennis Quaid Sues Drug Maker, Baxter Healthcare, Over Defectively Designed Heparin Drug Labels

Hollywood heavyweight, Dennis Quaid and his spouse recently filed a product liability lawsuit against Illinois based Baxter Healthcare over excessive doses of Heparin given to their new set of twins at Cedar Sinai Medical Center in LA.

The Quaid's assert that the drug maker negligently packed different doses of the medicine with the same color background and that different doses should have been designated with distinctive colors to avoid confusion.

In essence the Hollywood couple strongly feels that Baxter Healthcare should not have packed different doses of the drug with the same color and should have already recalled the defectively designed packaging after three children overdosed on the drug last year and died. The Quaid's apparently are holding off for now in suing Cedar Sinai Medical Center - a break for the hospital of choice for many of Hollywood's elite - given that Cedar Sinai has all but conceded that several of their pharmacy techs and nurses neglected to verify the exact dosage of Heparin before administering it to the Quaid twins, Thomas and Zoe.

The Quaid's have a right to be upset I do not blame them. Baxter Healthcare deflected blame to the Hospital, but Baxter knew and should have known that inadvertent misuse of the medicine is very foreseeable, thereby shooting down Baxter's defense of "Misuse". Time will tell. It is a good idea to absolutely double check with hospital nurses the exact dosage of a drug about to be given to your children, especially if you are not familiar with what are considered to be proper dosages and the Quaids most likely were not.

If you or a loved one has been injured by this or any other defective product, I would invite
you to contact my law firm, Sam Levine, Attorney at Law.
