Tow Truck Kills 11 Year Old Girl In Atlanta

An 11 year old girl, Alexis Allen, was struck and killed Friday by a tow truck while she was crossing the street on the way to school after getting off a Marta bus. The pedestrian accident occurred in the early morning. According to witnesses, the young girl was in the middle of the cross walk when the tow truck driver, Cirilo Figueroa, pulled around the bus and hit the girl, propelling her several feet into the air.

The girl died at the scene and unfortunately the mother witnessed everything. The tow truck driver claimed that he did not realize initially that he had struck the girl. The driver may face hit and run charges as it is alleged that he drove around the block after the pedestrian accident and then came back.

A wrongful death lawsuit is sure to follow.

Plane Crash In Tennessee Injures Three

Three people were injured when their plane crashed recently during takeoff from the Lewisburg airport in Tennessee. At the time of the plane crash, the plane was about 150 feet in the air. Luckily the passengers were not seriously injured. The same cannot be said of passengers of planes that recently crashed in New Jersey and the Pacific Northwest. The passengers in those plane crashes died and it is too soon to know whether any wrongful death lawsuits have or will be filed.

In the Tennessee plane crash, it is believed that the plane crashed because of engine trouble. After a thorough investigation, it should become clearer what the exact cause of the plane crash was and whether that may pave the way for an injury lawsuit.

Following the pedestrian accident, the driver, Desiree Britt, was cited for, among other things, possession of drug material and marijuana. Ms. Britt, according to records, has a criminal history that includes convictions for other traffic related offenses and battery.

The wrongful death lawsuit is expected to wind its way through the civil justice system and the family of the killed runner will, in all likelihood, take the case to trial, if the matter cannot be settled. Wrongful Death Lawsuit Filed Against Drunk Driver

A widower, Mark Kinstle, recently filed a wrongful death lawsuit against Mark Lusher alleging that Mr. Kinstle rear-ended his wife, Michelle Kinstle, while drunk. To make matters worse, it is also alleged that in the complaint that Mr. Lusher transferred over a $100,000 to his wife to keep the Kinstle family from putting their hands on the money. Mr. Lusher already faces criminal charges related to the car accident, including vehicular homicide and DUI.

At the time of the accident in rural Ohio, Mark Lusher was driving a Chevy Silverado truck and if he is convicted on all the charges, he faces substantial jail time. Lusher's attorney chimed in by stating that "it is premature for Kinstle to seek Lusher's assets." Do not be surprised if Kinstle's attorney files some papers with the court to prevent Lusher from transferring or disposing of his various assets in order to insulate himself personally from a judgment.

Based upon the complaint, Lusher was triple that of the legal blood alcohol level limit and after the crash, he kept going thereby failing to come to the aid of Michelle Kinstle. Punitive damages are sought in this wrongful death case.

Wrongful Death Lawsuit Filed Against Trucking Company Over Deadly Car Crash

A tragic accident occurred recently in central Kentucky involving a truck driver, Richard Gussler, who is alleged to have been under the influence of drugs or alcohol, and another car, which has led to a wrongful death lawsuit against the Trucker's company. The wrongful death lawsuit involving the 18 Wheeler was brought by the spouse of a man, Joey Kirk, who claims that the trucker was drunk or on drugs when he slammed into the rear of her husband's car, killing him instantly.

The deceased's wife is pushing for $10,000,000 in damages against the trucker's employer. Incidentally, the trucker was charged with manslaughter, a felony of course, which if convicted, should help boost the civil wrongful death claim, particularly in the eyes of the jury, if the case gets that far. The trucker's employer, Mountain City Ford, stands to get hit with a sizable jury verdict, especially if the Plaintiffs can prove the trucker was intoxicated in some way.

These folks who operate big rig 18 wheelers really do have a huge responsibility to drive with extreme caution. Failure to do so, particularly when compounded by intoxication can, as we see, lead to deadly consequences.

If you or a loved one has been affected or touched by this type or any other type of deadly accident, I would invite you to please visit my website, www.samlevine.com or contact my office, Sam Levine, Attorney at Law.

The family of Syblen and Andrew McAbee, both of whom were killed in a car accident by a drunk driver, have filed a wrongful death lawsuit. The lawsuit, filed in an Anderson, South Carolina court, seeks money damages against not only the drunk driver, but also the driver's employer (Craft Construction Company) because the drunk driver was operating the construction company's truck at the time of the tragic accident.

As with any wrongful death lawsuit, the named Plaintiff's include the survivors (the children) and the victims' estate. The named Defendant is Robin Blair and there were a total of three people who lost their lives.

The Defendant Robin Blair was charged with DUI and his criminal prosecution will no doubt assist in the prosecution of the wrongful death lawsuit.

Wrongful Death: Truck Accident Lawsuits On Horizon After Pileup in Florida

Numerous people are expected to file lawsuits, including for wrongful death, shortly after a pileup involving multiple 18 Wheelers in Orlando, Florida this past week. The potential Plaintiffs are sifting through all of the evidence and facts to determine exactly who will be named as Defendants in the lawsuit. It is a foregone conclusion that one or more of the tractor trailer drivers and their respective companies will be named in the complaint.

The pileup involved a couple of minivans and one of the potential plaintiffs is barely hanging on with life support. Florida officials were in the process and in fact did start a fire to burn dry brush, so the State could be named as a Defendant. Time will tell. No matter who are ultimately named as Defendants in this wrongful death lawsuit, it is sad and tragic.

Accidents like these could and should be avoided. If you or a loved one has been injured or killed in an 18 wheeler truck accident like this one, please contact my law office, Sam Levine, Attorney at Law, for a free consultation.

Family Weighs Wrongful Death Lawsuit Against Truck Driver

The family of a Florida woman is considering filing a wrongful death lawsuit against another truck driver following what has been described as a fiery crash that took place in rural Alabama just before Christmas. One of the two trucks, the log hauler, pulled out in front of another trucker, Deborah Fields, causing her to strike the rear of the log hauler.

The log hauler was cited for failure to yield the right of way and now faces criminal charges. It is unlikely that the family of the 18 wheeler operator will not file suit under these tragic circumstances.

Also facing a potential wrongful death lawsuit is the log hauling company itself given that the log hauler was oin the job at the time of the truck accident.
